1. Acceptance of Terms
These Terms & Conditions (“Terms”) govern your use of the ATLPMA Meditation App (“App”) provided by Atlanta Pyramid Meditation Academy (ATLPMA).
The App is developed and published by Fipple IT Technologies Pvt. Ltd., Visakhapatnam, India (“Fipple”) on behalf of ATLPMA.
By accessing or using the App, you agree to these Terms. If you do not agree, you must stop using the App.
2. Ownership & Developer Role
- Fipple is the exclusive owner of all materials, including but not limited to ideas, content, designs, images, resources, audio, video, technical architecture, and source code used in or created for the App. All rights are reserved by Fipple.
- ATLPMA is granted a limited, non-exclusive, non-transferable license to use these materials solely for operating and managing its meditation and community programs. ATLPMA does not hold ownership rights.
- Users are granted only a personal, non-commercial right to use the App.
3. Eligibility
- The App may be used by individuals of all ages. We do not apply any age-based restrictions or filters.
- If a minor uses the App, it is the sole responsibility of the parent or legal guardian to supervise and approve such use, including the sharing of personal information.
- By using the App, all users (or their parents/guardians, in the case of minors) agree to these Terms.t.
4. Use of the App
You agree to:
- Use the App only for lawful, non-commercial purposes.
- Not copy, modify, distribute, or resell any App materials.
- Not attempt to hack, disrupt, or misuse the App.
- Respect community guidelines during online or in-person events.
5. User Accounts
- You must provide accurate details when registering.
- You are responsible for safeguarding your login credentials.
- ATLPMA reserves the right to suspend or terminate accounts for violations.
6. Intellectual Property
- All App-related intellectual property, including materials originally provided by ATLPMA, belongs to Fipple IT Technologies Pvt. Ltd.
- ATLPMA holds licensed rights to use these materials for its programs but does not own them.
- Users may only use the App for personal meditation and wellness purposes.
7. Disclaimers
- The App provides meditation and wellness practices for informational and educational purposes only.
- It is not a substitute for medical, psychological, or professional advice.
- Participation is voluntary and at your own risk.
- The App is provided “as is,” without warranties of accuracy, availability, or fitness for a specific purpose.
8. Limitation of Liability
To the maximum extent permitted by law:
- ATLPMA and Fipple are not liable for injuries, losses, or damages arising from App use.
- We are not responsible for interruptions, downtime, data loss, or technical issues.
- Users are solely responsible for ensuring their device and network security.
9. Indemnity
You agree to indemnify and hold harmless ATLPMA and Fipple against any claims, damages, liabilities, or expenses arising from:
- Your misuse of the App.
- Your violation of these Terms.
- Any breach of applicable laws.
10. Force Majeure
ATLPMA and Fipple shall not be held liable for failure or delay in performance due to events beyond their reasonable control, including but not limited to: natural disasters, cyberattacks, technical failures, or government restrictions.
11. Termination
We may suspend or terminate your access at any time without notice if you violate these Terms or misuse the App.
12. Changes to Terms
- We may update or modify these Terms & Conditions from time to time at our sole discretion.
- Updates will be communicated through one or more of the following:
- Email notification to the address you provided,
- In-app notifications, or
- Posting on the App or our official website.
- By continuing to use the App after such updates, you agree to be bound by the revised Terms.
- If you do not agree to the revised Terms, you must stop using the App.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Disputes shall first be resolved amicably. If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
- Place of arbitration: Visakhapatnam, Andhra Pradesh, India.
- Language: English.
- Subject to arbitration, courts at Visakhapatnam shall have exclusive jurisdiction.
